INFORMATION NOTICE ON THE PROCESSING OF PERSONAL DATA

Your personal data may be processed by ARSO GROUP İNŞ.TURZ.SAN.TİC.LTD.ŞTİ. within the scope of the Personal Data Protection Law No. 6698 ("Law"). Within the scope of the Law, "ARSO GROUP İNŞ.TURZ.SAN.TİC.LTD.ŞTİ." is considered as the data controller.

ARSO GROUP İNŞ.TURZ.SAN.TİC.LTD.ŞTİ. (ALTINTAŞ MAH. 31110 CAD. NO:21/1 AKSU/ANTALYA) as the "Data Controller", pays utmost attention to the security and lawful processing of your personal data. With this awareness, as a company, we attach great importance to the processing and protection of the personal data of our customers, potential customers, employees, employee candidates, authorized persons of suppliers/subcontractors, our company shareholders, and partners, visitors, and other third parties whose data we process, in accordance with the Personal Data Protection Law No. 6698 ("KVK Law"). With this responsibility in mind, as the "Data Controller" defined in the KVK Law, we process your personal data within the scope of the purposes and legal reasons stated below and within the limits imposed by the legislation.

PURPOSE OF PROCESSING YOUR PERSONAL DATA

Processing of your personal data is defined as any operation performed on personal data such as obtaining, recording, storing, retaining, modifying, reorganizing, disclosing, transferring, acquiring, making available, classifying, or preventing the use of personal data, wholly or partly, by automated or non-automated means, provided that they form part of a data recording system. Your personal data is processed in accordance with the Personal Data Protection Law No. 6698 and secondary regulations, within the scope of the purposes and legal reasons stated below.

In this context;

• Your personal data such as name, surname, Turkish ID number, signature, email, address, telephone, information on the purchased real estate, identity information, payment information of the sales price, etc., are processed for the establishment and performance of contracts (for the purpose of establishing and performing a real estate sales promise contract),

• Your personal data such as name, surname, email, telephone, etc., are processed for informing you about our company's campaigns with your consent,

• Your personal data such as identity information, information on the purchased real estate, etc., are processed for performing necessary title deed transactions, sales promise contract transactions, notary transactions, subscription transactions in your name by our company, and for issuing power of attorney for transactions to be performed by our employees in your name,

• Your personal data is processed for carrying out necessary work by our business units to benefit you from the products and services offered by our company; for customizing and recommending the products and services offered by our company according to your likes, usage habits, and needs; for ensuring the execution of our company's human resources policies; for ensuring the legal and commercial security of our company and individuals in business relations with our company; for determining and implementing our company's commercial and business strategies; and for conducting our company's commercial activities within the scope of the personal data processing conditions and purposes specified in Articles 5 and 6 of the Personal Data Protection Law No. 6698.

TO WHOM AND FOR WHAT PURPOSE DO WE TRANSFER PROCESSED PERSONAL DATA?

• Your collected personal data may be transferred to our business partners, subsidiaries (and/or third-party business partners required to share for performing the work), suppliers, company officials, shareholders, notaries, banks and relevant institutions, project partners, legally authorized public institutions and private individuals, in accordance with the personal data processing conditions and purposes specified in Articles 8 and 9 of the Personal Data Protection Law No. 6698, for the purposes of carrying out necessary work by our business units to benefit you from the products and services offered by our company; customizing and recommending the products and services offered by our company according to your likes, usage habits, and needs; ensuring the legal and commercial security of our company and individuals in business relations with our company (such as carrying out construction, sales, and administrative operations, ensuring the physical security and control of company locations, managing customer evaluation/complaint processes, reputation research processes, event management, legal compliance process, audits, financial affairs, etc.); determining and implementing our company's commercial and business strategies; and ensuring the execution of our company's human resources policies. Additionally, it may be transferred to firms acting as data processors for the purpose of maintaining personal data records.

• Your personal data may be shared with our business partners, public legal entities, and judicial authorities when necessary for performing our activities. We may share your personal data within the scope of the purposes specified above and in accordance with the legislation and your explicit consent, with natural persons or private law legal entities, shareholders, business partners, subsidiaries and affiliates, suppliers, authorized public institutions and organizations, private insurance companies, auditors, consultants, contractual service providers, domestic organizations we cooperate with, and on our social media account, in accordance with the purposes specified in Article 8 of the Law; and under the conditions specified in Article 9 of the Law, provided that the conditions for cross-border transfer are met.

• We send commercial electronic messages about our products and services, new product and service introductions, and special offers to your contact information with your permission. These messages are stopped upon your request.

• In sharing your personal data, the provisions of Articles 8 and 9 of the KVKK are complied with, and all necessary technical and administrative measures are taken to ensure data security during and after the sharing process.

METHOD AND LEGAL BASIS OF COLLECTING PERSONAL DATA

• Personal data such as identity information, contact information, professional, commercial, and financial information is collected, wholly or partly by automated means or by non-automated means such as forms and similar printed documents, verbally, in writing, or electronically, in order to provide our products and services within the legal framework determined, to sell them, and to fully and correctly fulfill our company's contractual and legal responsibilities. The personal data collected for this legal reason can be processed and transferred for the purposes specified in Articles (1), (2), and (3) of this text, within the personal data processing conditions and purposes specified in Articles 5 and 6 of the KVKK.

STORAGE AND RETENTION PERIODS OF PERSONAL DATA

• Our company stores personal data for the period specified in the relevant legislation and regulations. If no period is specified in the legislation, personal data is processed for the duration required by our company's practices and the customs of the commercial life, and then deleted, destroyed, or anonymized. If the purpose of processing personal data has ended, and the retention periods determined by the relevant legislation and our company have expired, personal data is retained only for the purpose of providing evidence in possible legal disputes or for the assertion or defense of a right related to personal data. During this period, personal data is not accessed for any other purpose, and it is only accessed if necessary for the legal dispute. After this period, personal data is deleted, destroyed, or anonymized.

YOUR RIGHTS REGARDING YOUR PERSONAL DATA;

As individuals whose personal data is processed by our company, if you submit your requests regarding your rights to us, our company will conclude the request free of charge within the shortest time and at the latest within thirty days depending on the nature of the request. However, if the process requires an additional cost, our company will charge the fee determined by the Personal Data Protection Board. In this context, as individuals, you have the following rights:

• To learn whether personal data is processed or not,

• To request information if personal data is processed,

• To learn the purpose of processing personal data and whether they are used in accordance with their purpose,

• To know the third parties to whom personal data is transferred domestically or abroad,

• To request the correction of personal data if it is incomplete or inaccurately processed and to request the notification of the process performed in this context to the third parties to whom the personal data has been transferred,

• To request the deletion or destruction of personal data despite being processed in accordance with the KVKK and other relevant legal provisions, in case the reasons for processing no longer exist and to request the notification of the process performed in this context to the third parties to whom the personal data has been transferred,

• To object to the occurrence of a result against the person himself/herself by analyzing the processed data exclusively through automated systems,

• To demand the compensation of the damage in case of suffering damage due to the unlawful processing of personal data.

In accordance with Article 13, paragraph 1 of the Law No. 6698, you need to submit your request regarding the use of your above-mentioned rights to our company in writing or by other methods determined by the Personal Data Protection Board. The Personal Data Protection Board has not determined any methods at this stage, so you need to submit your application to our company in writing in accordance with the KVKK. In this context, you need to submit your written request including your identity-confirming necessary information and explanations regarding which of your rights specified in Article 11 of the KVKK you wish to exercise, to the address “ALTINTAŞ MAH. 31110 CAD. NO:21/1 AKSU/ANTALYA” in person with identity-verifying documents, via notary, or by using other methods specified in the KVKK. The company will conclude the request free of charge within the shortest time and at the latest within thirty days, depending on the nature of the request. As the company is obliged to keep records and documents related to its activities for a specific period according to the relevant legal regulations, if you request the deletion, destruction, or anonymization of your personal data, this request will be fulfilled by the Company after the period determined by the legal regulations. However, during this period, your personal data will not be processed by the Company, except in legally mandatory situations, and will not be shared with third parties except for legal obligations arising from national and international regulations and contracts.

CONSENT STATEMENT

I have been informed about the methods, purposes, and legal reasons for the processing and transfer of my personal data by ARSO GROUP İNŞ.TURZ.SAN.TİC.LTD.ŞTİ., as well as about the rights I hold. I declare that I have been adequately informed about all the issues mentioned above, that I have read and understood the Personal Data Protection and Processing Policy and the Storage and Disposal Policy, and that I am aware of my rights under Article 11 of the Law No. 6698. I consent to the processing of my personal data collected verbally, in writing, or electronically by the Data Controller for legitimate interests such as security, auditing, health, as well as for contractual or legal reasons, in a manner related, limited, and proportional to the purpose of processing, and I agree to receive commercial electronic communications.
